DEFINITIONS
“Linknet” means Linknet Communications NSW
Pty. Ltd. (ACN 105 220 399) and its successors in business, agents,
administrators, substitutes and permitted assigns. “Linknet
” also means Linknet and its related bodies corporate.
COLLECTION
Linknet collects information directly from its Members. This is
done by way of their written application form submissions or by
telephone conversations held with them. Linknet does not collect
information about Members from any third party. The information
collected is necessary for the legitimate functions and activities
of Linknet.
USE
The primary purpose for the collection of personal information from
Members by Linknet is to provide them with Internet Access and associated
services. In order to do this Linknet must be able to identify the
Member and ensure that they are over the age of eighteen years where
consent of a parent or guardian has not been given. Linknet must
be able to communicate with the Member by email, mail and telephone.
With respect to Business Accounts, Linknet gives a business the
opportunity to supply their Australian Business Number. This is
optional. The sole purpose for collection of an ABN is to include
it on the Tax Invoice of the Business Account holder. This information
is not used for any other purpose.
Linknet will only use personal information for a purpose other
than the primary purpose of collection if:
The secondary purpose is related to the primary purpose of collection;
and
The subject of the information would reasonably expect Linknet to
use the information for the secondary purpose; and
The use is made in the performance of Linknet’s duties; or
The Member has consented to the use; or
Linknet reasonably believes that the use is necessary to lessen
or prevent a serious and imminent threat to an individual's life
or health; or
Linknet has reason to suspect that unlawful activity has been, is
being or may be engaged in, and uses the personal information as
a necessary part of its investigation of the matter or in reporting
its concerns to the relevant persons or authorities; or
The use is required or specifically authorised by law; or
The use is reasonably necessary for the enforcement of the criminal
law, a law imposing a pecuniary penalty, or for the protection of
the public revenue.
DISCLOSURE
Linknet will disclose personal information for a purpose other than
the primary purpose of collection if:
The secondary purpose is related to the primary purpose of collection;
and
The subjection of the information would reasonably expect Linknet
to disclose the information for the secondary purpose; and
The disclosure is made in the performance of Linknets duties; or
The Member has consented to the disclosure; or
Linknet reasonably believes that the use is necessary to lessen
or prevent a serious and imminent threat to an individual's life
or health; or
Linknet has reason to suspect that unlawful activity has been, is
being or may be engaged in, and uses the personal information as
a necessary part of its investigation of the matter or in reporting
its concerns to the relevant persons or authorities; or
The use is required or specifically authorised by law; or
The use is reasonably necessary for the enforcement of the criminal
law, a law imposing a pecuniary penalty, or for the protection of
the public revenue or has been certified as reasonably necessary
by an Authorised Officer of an enforcement Agency; or
The disclosure is made to an officer or employee of ASIO authorised
to receive it and in connection with the performance of ASIO's functions.
Data Quality, Security, Openness, Access and Correction.
Linknet Members may access their personal information at the Linknet
Usage Statistics Page. Members may require their login name and
password to access this information. Members are encouraged to check
the information on a regular basis to ensure it is correct and up
to date. Where information held is no longer correct, they may either:

TRANSBORDER DATA FLOW
Linknet will not transfer personal information outside Australia unless:
Linknet believes that the recipient of the information is subject to
a statute, binding scheme or contract which effectively upholds principles
for fair information handling that are substantially similar to the
Protection of Personal Information of Customers of Telecommunications
Providers Code registered by the Australian Communications Authority.
